Anticipatory bail for maulana who ‘made offensive speeches’

While addressing a gathering at Ghatkopar last month, Maulana Sheikh Rabbani had allegedly made abusive and hurtful remarks against a saint

A week after being untraceable, Maulana Sheikh Mehraj Rabbani of the radical Ahle Hadees appeared before the Sessions Court on Tuesday in a case of hurting religious sentiments of Dargah-going Sunni Muslims by his allegedly offensive speeches. Hearing his anticipatory bail plea, the court granted him interim relief from being arrested till February 16.

On January 30, the Ghatkopar police registered an offence against the maulana for allegedly hurting the religious sentiments of fellow Muslims, mostly Sunnis of the Barelvi denomination.

While addressing a gathering on January 28 at Ghatkopar’s Chirag Nagar, Rabbani had allegedly made abusive and hurtful remarks against Khwaja Garib Nawaaz, a saint whose shrine at Ajmer is India’s most famous Sufi shrine. At that time, a massive mob of protesters had gathered at the venue demanding an apology from Rabbani, but police escorted him to safety.

With Rabbani’s speeches escalating tension between different sects, police finally registered a complaint against him. Muslim leaders and scholars approached Home Minister R R Patil, apprehending a law and order situation.

Seeking anticipatory bail, Rabbani claimed before the court that he had not delivered any speech as alleged in the FIR. The court, however, noted that this could not be determined until the investigating officer’s report on the evidence is submitted and thereby granted Rabbani interim relief.

Meanwhile, Rabbani - who makes frequent trips to Saudi Arabia - has surrendered his Indian passport to the Sessions Court.

As the police escorted him out of the court, a group of Barelvis gathered around the van and began shouting slogans against him. As the van picked speed, some protestors climbed onto the van and began banging on the windows, attempting to hit Rabbani.

Advocate Rizwan Merchant, who has filed an intervening application to oppose Rabbani’s plea, said, “Despite the police issuing a gag order on Rabbani, he again made offensive speeches on February 1 and 2 in Kurla, Kandivli and Kalyan. His utterances not only abuse the revered Khwaja Garib Nawaz, but also the saint’s followers. Such speeches are capable of causing communal disharmony, creating law and order problems, putting the state’s security at stake.”

However, as Rabbani’s lawyer Sudeep Pasbola said, “Rabbani has never stated any such thing in his speeches. His recorded speech doing the rounds is one he had delivered in Saudi Arabia many years ago, in some other context.”

By TCN News,

Mumbai: A delegation of Markazi Jamiat Ahle Hadith of Maharashtra met Maharashtra Home Minister Mr. R.R. Patil on February 12 to clarify their position on the allegations from Barelvis that clerics of Ahle Hadith are spreading hatred.

Rejecting the allegation that they are spreading hate, the delegation told Mr. Patil that they believe in promotion of high human behavior, peace and communal harmony and they avoid any such thing which could lead to conflicts, confrontation and disrupt peace.

The tension between these two Muslim sects started after Maulana Meraj Rabbani, an Ahle Hadith cleric, addressed a gathering in Ghatkopar, Mumbai on January 28, 2010 in which according to Barelvis, Maulana Meraj made some remarks against Barelvis. They filed lawsuit against him in court demanding ban on speeches delivered by him. Since then the war of words is going on in the state.

The delegation claimed that the CD which is presented before the administration is decade old and Maulana Meraj Rabbani has since visited Mumbai many times and made speeches.

Mr. Patil assured the delegation of fair action in the matter and appealed to all to maintain peace. He also asked them to take care of each other's feelings and sentiments and wait for the decision of court.

The delegation comprised Maulana Muqeem Faizi, Gen. Secretary, Markazi Jamiat Ahl-e-Hadith Hind, Maulana Abdus Salam Salafi, President, Maharashtra Jamiat Ahl-e-Hadith, Mumbai, Maulana Syed Ahmed Bastawi, Nazim, Jamiat Ahl-e-Hadith, Mumbai, Maulana Manzar Ahsan Salafi, Qari Najamul Hasan Faizi, President, Jamia Rahamania, Kandivali, Maulana Abdul Haq Qasmi, President, Salafi Society, Kurla, Maulana Ajmal Rafiq Asari, Maulana Shafiq Salafi, Al-Markaz-ul-Islam, Mumbra , Maulana Jamil Ahmed Salafi, Abdul Bari Saheb, Shafiullah Saheb, Muhammad Najeeb, President, Trust Board, Jama Masjid, Ahl-e-Hadith, Mominpura, Maqsood Allauddin Saheb, General Secretary, Al-Markaz-ud-Dawatul Islamia, Saunas.

Typical the mushrik Barelawis go running to their brothers in religion the Hindus.

As I heard the Hindus in India say to the Barelawis -

"The only difference between us and you is that our gods are standing and your gods are lying down (i.e. in graves)"

Probe Rabbani’s Pakistan link, court urged

Opposing anticipatory bail plea of Rabbani, whose speech created a furore last month, lawyer for offended Sunni alleges speeches could be a conspiracy to destabilise India

..........................................................................

Close to a month after his allegedly offensive speeches caused a furore among Sunni Muslims, the argument over giving relief to Maulana Sheikh Mehraj Rabbani of the radical Ahle Hadees sect, is getting increasingly heated.

Staunchly opposing Rabbani’s anticipatory bail plea, advocate Rizwan Merchant on Thursday argued before the sessions court that Rabbani's allegiance to a Pakistan-based Islamic Web site, that contains several of his ‘hate’ videos, must be investigated to see if it is part of a larger conspiracy to destabilise India.

On January 30, the Ghatkopar police registered an offence against Rabbani for allegedly hurting sentiments of Muslims, mostly Sunnis of the Barelvi denomination. While addressing a gathering on January 28 at Chirag Nagar, Rabbani allegedly made abusive remarks against Khwaja Garib Nawaaz, a saint whose shrine at Ajmer is India's most famous Sufi shrine.

A mob at the venue demanded an apology, but police escorted Rabbani to safety. With Rabbani’s speeches escalating tension between different sects, the police finally registered a complaint. Seeking anticipatory bail, Rabbani approached sessions court, claiming he had not made any speech as alleged.

On Thursday, Merchant, who has filed an intervening application on behalf of one Siraj Rashid to oppose Rabbani's plea, argued before sessions judge R G Avchat that Rabbani has allegedly come to India on a mission to foment hatred, and hence he abused not just Muslim saints, but also passed offensive remarks against Hindu and Christian gods.

Merchant submitted CD copies and transcripts of Rabbani's speeches to the court and the police. In one audio transcript Rabbani allegedly says, “If you put George Bush and Tony Blair in a room with a Bible and ask them their opinion on Jews, even they will say how bad and unfaithful Jews are.” Merchant argued, “We must not forget that 26/11 targeted Jews, and that Rabbani is provoking people against Jews and using words like Jihad.”

In an affidavit filed on Thursday, Rashid stated that Rabbani was invited from Saudi Arabia by a certain ‘association of persons’, who are conspiring to spread communal hatred by deliberately using abusive and demeaning words against walis (friends) of Allah. Merchant pointed out, "Rabbani's roots appear to be shrouded under an alleged association 'Islamic Research Centre' which, as per its Web site, has its head office in Rawalpindi. His roots and his interests in Rawalpindi need to be investigated."

Merchant added, “On YouTube, if one searches for 'sufi aur shaitan', one can find 2,799 of his speeches. Despite police issuing a gag order on Rabbani, he again made offensive speeches on February 1 and 2. This seems to be a conspiracy to cause enmity within and destabilise India.”

The prosecution also told the court that they chanced upon a Web site which has Rabbani’s offensive speeches, which may also be the reason why police recently slapped the additional Section 153 A (promoting enmity on grounds of religion, race, etc) against Rabbani. Sudeep Pasbola, Rabbani’s lawyer refused to comment. The court will pass its order on March 6.

AsSalaamu alaykum wa Rahmatullahi wa Barkaatuhu,

I don't know about the Indian law, but isn't it true that every religion in India is open to criticism according to law(eg, Anti-Muslims like Arun Shurie(this guy has a petition in th e Calcutta High court for Banning Qur'an, the case is going on for years..), Ram Swarup..etc have anti-Islamic books but yet they aren't in Jail))

So , why is Ustad Meeraj Rabbani , being held ? Did he abuse the Sufi Saints? I agree that Ustad is a bit aggresive, but I don't think he can go to the extent of abusing and inciting violence.

So , sad , we Sunni/Salafi/Athari have no unity , nor any support(except Allah Azz wa Jall, Ar-Raheem wal Kareem), and the Kuffar hate us the most, also these Mubtadi'ah are keen to join hands with Kuffar to try and defeat Islam.

Thats the reason Islam isn't Growing in Indian Subcontinent. All credit to the Mubtadi'ah Tablighis,Jamaat-e-Islami, Barelwis.....

AsSalaamu alaykum wa Rahmatullah.

Rizwan Merchant sounds like a proper sell-out. He lived up to his name in trading the akhirah for the dunya, may Allah guide him or break his back.

‘Hate preacher’ Rabbani inciting people to carry out blasts, court told

The lawyer for Sunni Muslims on Tuesday submitted additional incriminating evidence to the Sessions Court against ‘hate preacher’ Maulana Sheikh Mehraj Rabbani of the radical Ahle Hadees sect.

Rabbani was booked by the Ghatkopar police in January for allegedly hurting the sentiments of Barelvi Sunni Muslims by making abusive remarks against saint Khwaja Garib Nawaaz, whose shrine at Ajmer is India’s most famous Sufi shrine.

On Tuesday, Sessions Judge R G Avchat rejected his anticipatory bail plea.

Before the order, lawyer Rizwan Merchant presented a VCD containing another inflammatory speech in which Rabbani allegedly asks his followers to carry out bomb blasts to demolish dargahs and temples.

“These VCDs are manufactured in Bangalore, but are being distributed by Rabbani’s organisation all over India and hence his custodial interrogation is essential,” Merchant told the court.

Merchant also filed a plea stating, “Rabbani’s grave provocation to demolish and bulldoze dargahs and pull off tombs, if need be by blasting them with bombs, is suggestive of his proposed subversive activities in India.”

The lawyer said, “If this is the extent of Rabbani’s views, he should also be probed for his role in the recent Ajmer Sharif blast.”

Another lawyer, S K Halwasia, also submitted some material from the Internet that apparently indicates Rabbani has links with alleged LeT operative David Headley and 26/11 mastermind Hafiz Saeed.

The court took both the lawyers’ contentions on record, and granted Rabbani interim protection from arrest for two more days so that he can appeal before the HC.

Rabbani’s lawyer, Sudeep Pasbola, said he is unaware of the VCD or other revelations, and that they have already moved the HC.

Puts off Maulana Sheikh Rabbani’s anticipatory bail hearing until it has gone through transcripts; tells police not to arrest cleric till next hearing on April 7

By Manoj R Nair
Posted On Friday, March 19, 2010 at 02:19:56 AM

The Bombay High Court has asked for the transcripts of two CDs, in which a cleric belonging to the radical Ahle Hadees sect allegedly spews hatred against Dargah-going Muslims, especially followers of the Sufi saint Khwaja Garib Nawaz.

Maulana Sheikh Mehraj Rabbani’s earlier plea for bail had been rejected by the Sessions Court

On Thursday, the court heard the anticipatory bail application of the cleric, Maulana Sheikh Mehraj Rabbani, whose earlier plea for bail had been rejected by the Sessions Court.

Rabbani had approached the courts for bail after a complaint was filed at the Ghatkopar Police Station against him by a local resident, Siraj Ahmed Shaikh, who alleged that he had hurt the sentiments of other Muslims with his offensive comments about the saint.

The comments were made by Rabbani at a meeting on January 28 at Chirag Nagar in Ghatkopar. The police have registered a case under Sections 295 (A) and 153 (A) of the IPC that relates to incitement of religious hatred.

The bail application will be heard again on April 7 and the police have been instructed by the court not to arrest the cleric till it gives its decision on bail.

The court wanted to see the transcripts before giving its decision in the bail application.

The High Court also asked the police to take custody of Rabbani’s passport that has been deposited with the Sessions Court.

Rabbani has also been asked not to make any public speeches till his application is disposed of. Shaikh’s lawyer, Rizwan Merchant, said that they informed the court about the presence of hundreds of CDs that feature speeches against Sufis and dargahs.

“There are statements exhorting people to take up jihad and demolish dargahs,” said Merchant. Radical Muslim sects consider dargahs as ‘grave worship’ and hence, against Islamic principles.

However, Rabbani’s representatives told the court that the speech mentioned by the complainant was recorded in Saudi Arabia several years ago.

Rabbani’s lawyer, Basil Qazi, said that his client has not insulted Sufi saints in his speeches. “He has been falsely implicated. Even the statements made by him in the CDs and at Ghatkopar were said in a particular context. If you listen to the whole speech, you will realise that he has not said anything offensive,” said Qazi.
